Warning da Viacom

Un mio collega ha ricevuto due giorni fa la seguente mail dal suo fornitore di ADSL

Oggetto: Violazione del diritto d'autore e di altri diritti connessi al suo esercizio

Gentile Cliente,

facciamo seguito a quanto anticipato telefonicamente in data odierna (ticket no.xxxxx) per
comunicarVi che abbiamo ricevuto diverse segnalazione (vedi in allegato alla mail) in merito
a download non autorizzato di materiale protetto dalle norme del diritto d’autore (Legge 22
aprile 1941 n. 633). Tale attività ha avuto origine da una delle vostre macchine identificata dall’
xxx.xxx.xx.x che risulta appartenere alla classe di IP Pubblici a Voi assegnata (xxx.xx.xxx.xx/
xx)

Vi informiamo che, ai sensi del D.Lgs 9 aprile 2003 n. 70, se la violazione segnalataci dovesse
corrispondere a verità dovremmo prendere opportuni provvedimenti come da disposizioni
legislative.

Vi invitiamo pertanto a verificare quanto sopra indicato e confidiamo che opportuni provvedimenti
saranno adottati senza ritardo.

Detto ciò, lui non ha mai scaricato i file dei quali è accusato! In più facendo ricerca su internet non abbiamo trovato molti casi ed aiuti sul come procedere in questi casi. Il fornitore suggerisce di fare una dichiarazione che è stato capito il tutto e di cancellare i file incriminati.
Ma com'è che di tutte le linee, tutte scaricano di continuo e le accuse vengono solo a lui, cioè io ho lo stesso fornitore (abbiamo attivato insieme 4 mesi fa) e non mi è mai arrivata nessuna segnalazione (finora :afraid: ) e a lui adesso arrivano accuse su file che non ha scaricato effettivamente.
Consigli? soluzioni?

Se vedete che mi sono scordato di cancellare qualche info non completamente pubblica per favore informatemi :)

Quello suo sarà sicuramente privato

Mi sembra difficile che da chissà dove si mettano a fare casini a un privato, secondo me mandando lettera, magari di un avvocato, dicendo che non è stato intenzionale e che verrà cessata qualsiasi futura attività in quel senso può stare tranquillo.

Secondo me ha uppato quel file anche involontariamente e hanno beccato il suo ip provando a scaricarlo

A me pare una strxxxata... più che altro se è un problema di violazione dei diritti non dovrebbe al massimo arrivarti la finanza? che gli frega al provider? poi magari mi sbaglio, ma soprattutto che provvedimenti prendono? si eliminano i clienti da soli? lol

No Viacom non è un fornitore e un ente che credo sia contro le violazioni ed ha contattato il fornitore dell'ADSL dicendo che da un loro IP erano stati fatti sti traffici loschi e di controllare, tra l'altro non essendo neanche il fornitore a dare direttamente l'ADSL (c'è un altro reseller di mezzo), fornitore 1 ha contattato fornitore 2 che ha contattato, mio collega.
La prima cosa che ho pensato anche io è stata: fake!! Però lui giustamente prima di riprendere le normali attività di download vuole avere un paio di conferme e garanzie e tranquillità.
Più che altro mi interessava sapere se qualcun'altro si fosse trovato in situazioni simili.

Per me vanno a caso. Oltretutto se non ha mai scaricato il file che senso ha ?

Boh infatti mi sembra una grossa cazzata, magari qualcuno s'è infilato nella sua rete, non so..
